Once a Landlord has received the holding deposit, he will provide (or
instruct his Solicitor to provide) to the Tenant a draft copy of the Tenancy
Agreement. The Tenant is at liberty to request for any amendments to the
Draft Tenancy Agreement. At Home are fully conversant with
tenancy agreements, and are happy to liaise
with the Landlord and the Tenant on amendments to the Tenancy Agreement. The Estate Agents Authority
prohibits us from offering any legal advice and therefore we would advise prospective
Tenants to seek legal representation for themselves.
Once both parties have agreed to the terms and conditions of the Tenancy Agreement,
the Landlord (or his Solicitor) will draw up the final engrossments in duplicate.
The Tenant will sign both copies and return them to the Landlord along with cheques
for the security deposit and stamp duty.
A recent change in legislation, which became effective in July 2004,
states that Tenants no longer have security of tenure, and all tenancy
renewals are by mutual negotiation. At Home
will be happy to assist or advise at the time of re-negotiation.
